Dispute Resolution and Governing Law

In the event of any disputes arising between Marvelous Holidays, its guests, and the associated hotels, the following procedures will be implemented to ensure a fair and efficient resolution. All parties are encouraged to attempt to resolve disputes amicably through direct communication. Should this informal approach fail, the following formal dispute resolution mechanisms will be employed.

All disputes shall be governed by the laws of Pakistan, without regard to its conflict of law principles. Initially, any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, including the validity, invalidity, breach, or termination thereof, shall be submitted to mediation. The mediation process will be conducted in accordance with the mediation rules of an accredited mediation center in Pakistan. The parties agree to participate in good faith with the appointed mediator to resolve the dispute.

If mediation does not result in a settlement, the dispute shall then be referred to and finally resolved by arbitration. The arbitration will be conducted under the rules of the Pakistan Arbitration Act. The arbitration tribunal shall consist of one arbitrator, agreed upon by both parties. If the parties cannot agree on an arbitrator, an arbitrator will be appointed by the relevant arbitration authority in Pakistan. The place of arbitration shall be in Pakistan, and the language of the arbitration shall be English or Urdu, as agreed upon by the parties.

Any legal proceedings arising out of or in connection with these Terms and Conditions shall be brought exclusively in the courts of Pakistan. Each party irrevocably submits to the jurisdiction of these courts and waives any objections to such jurisdiction or venue. By agreeing to these terms, all parties acknowledge and consent to the procedures outlined above, ensuring that any disputes will be handled in accordance with Pakistani legal standards.
